TP/1126/2025 (E-filing) Mr. B. G. Saraf a/w. Suyash Kalbhor, Advocate for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Sunil Laxman Chhabra being sole surviving Executor named under the Will of deceased. The deceased namely Laxman Kishendas Chhabra died at Mumbai on 24.04.1995. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Passport is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 06.12.1993. The said Will is in English language. The Para No. 3 of the Will refers to the appointment of Executor. Only two Executor appointed under the Will. Petitioner is one of the executors and another executor namely Subhadra L. Chhabra died on 04.11.2024. Ld. Advocate for petitioner submits that TP No. 1452 of 2025 for the estate of said Subhadra and her death certificate is annexed thereto in that petition.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Wife of deceased died on 04.11.2024. Deceased was survived by one son and one married daughter. Out of them son is petitioner herein and daughter has given her consent in favour of the petitioner. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Anil Harish dated 19.02.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 29.03.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
