TP/1127/2025 (E-filing) Mr. S. U. Lakdwala, Advocate for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Radheshyam Murlidhar Jalan and Bharat Murlidhar Jalan being Executors named under the Will of deceased. The deceased namely Murlidhar Kishanlal Jalan died at Mumbai on 01.10.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 17.12.2018. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executor. Only three Executors appointed under the Will. Petitioners are executors and remaining executrix namely Ramidevi Murlidhar Jalan has renounced her rights to act as an executor and Affidavit of Renouncing dated 24.01.2025 is filed to that effect.

3. Ld. Advocate for petitioner submits that mother of deceased predeceased the deceased. Deceased had no daughter and was survived by widow and two sons. Out of them both the sons are petitioners herein and widow has given her consent in favour of the petitioner. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Shambhu Dayal Makharia dated 24.01.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 25.03.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
