TP/1128/2025 (E-filing) Mr. Vasim Siddiqui, Advocate for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Rita Sinha being sole Executor named under the Will of deceased. The deceased namely Arun Kumar Sinha died at Panvel on 22.08.2021. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Panvel on 19.08.2016 and the same is registered on 20.08.2016. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased had no son and was survived by widow and two daughters. Out of them widow is petitioner herein and both the daughters have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Srikant Vineet Iyengar dated 04.01.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation is not properly filed hence, Advocate file fresh Affidavit of Service of General Citation.

5. Ld. Advocate for petitioner seeks leave to correct the date of execution of the Will in the petition. Leave is granted. Ld. Advocate for petitioner to carry out corrections within four weeks from the date of uploading of this order. Ld. Advocate for petitioner re-upload the corrected petition on the official portal of the Bombay High Court.
