This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Cleto Apolinario Assuncao Aguiar being brother of deceased. Deceased namely Luis Roque Salvador Aguiar died intestate at Goa on 22.02.2005. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 04.12.2024 for dispensation of identification proof of deceased. The same is accepted.

2. Ld. Advocate for petitioner submits that deceased died as bachelor. Father of deceased died on 09.03.1985. Mother of deceased died on 23.071978. Deceased had no sister and was survived by one brother who is petitioner herein. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 17.03.2025 is filed. Since, petitioner is sole surviving legal heir Administration Bond is not required to be filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.
