TP/1268/2025 (E-filing) Mr. Ajit Shankar Hodage, Advocate for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Sajid Habib Patel being nephew of deceased. Deceased namely Raju Umar Patel died intestate at Mumbai on 16.10.2016. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 13.01.2025 for dispensation of identification proof of deceased. The same is accepted.

2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased died as bachelor. Deceased had one brother namely Habib Umar Patel who died on 12.12.2000, leaving behind two sons namely Sajid Habib Patel and Sohail Habib Patel. Wife of the said Habib Patel died on 20.08.2017. Deceased was survived by two nephews. Out of them one nephew is petitioner herein. Petitioner has given the consent on behalf of another nephew namely Sohail Habib Patel being his Constituted Attorney. Power of Attorney is annexed to the petition. Consent Affidavit is on record. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 02.04.2025 and Administration Bond dated 25.04.2025 are filed. Delay is explained. All other legal formalities are complied with. Hence, petition is granted.
