TP/1315/2025 (E-filing) WITH WILL/528/2025 Mr. Nikhil Sonar i/by W3Legal LLP, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Nitin Srivastava being the Executor named under the Will of deceased. The deceased namely late Madhuri Srivastava, died at Mumbai on 02.04.2016. Copy of death certificate is annexed to the petition. Identification proof of deceased i.e. copy of Aadhaar Card is annexed.

2. The deceased left behind him last Will and Testament which was duly executed at Kanpur, on 19.05.2006. The said Will is in Hindi language and official translation of the said Will is separately uploaded on the official portal of the Bombay High Court. Ld. Advocate states that the Petitioner has filed the affidavit dated 5.08.2025 stating that the word "Nishpaadit" in the Will means 'Executor'. The first page of the Will at Serial No. 5 and para No. 3 of the Will refers to the appointment of Petitioner as a Sole Executor.

3. Ld. Advocate for petitioner submits that parents of the deceased predeceased the deceased. Husband of the deceased died on 03.06.2020. Deceased was survived by one son and two daughters. Out of them the son is Petitioner herein and the both the daughters have given their consents in favour of the Petitioner herein. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Anilkumar Avasti dated 22.01.2025 one of the Attesting Witnesses to the Will is filed. Affidavit of General Citation is dated 04.04.2025 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
