TP/1350/2025 (E-filing) Mr. Pranil P. Lahigade, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. Objection as regards the court fees recorded in the order 27.06.2025 has been dispensed with by the Hon'ble Court as per order dated 17.09.2025 in Interim Application (L) No. 28886 of 2025. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Anil Rajaram Kamble being sole Executor named under the Will of deceased. The deceased No. 1 namely Rajaram Balu Kamble died at Mumbai on 19.08.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition. The deceased No.2 namely Shantabai Rajaram Kamble died at Navi Mumbai on 05.10.2020. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind their last Will and Testament which was duly executed at Mumbai on 08.02.2010. The said Will is in English language. The last para of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. Residuary clause in respect of properties of deceased is mentioned at page No. 6 of the Will.

3. Ld. Advocate for petitioner submits that parents of both the deceased predeceased the deceased. Both the deceased are husband and wife. Deceased was survived by one son and two married daughters. Out of them son is petitioner herein and both the married daughters have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Shailesh Ravindranath Erande dated 18.02.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 05.04.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
