Ld. Advocate for the petitioner submits that the department has withheld the grant on the point that this petition is found to be cross-petition with the Testamentary Petition No. 04 of 2005.

Ld. Advocate for the petitioner submits that the petitioner informed that deceased died without leaving any Will and therefore, this petition is not of the deceased. 3.

Hence, it would be proper to call the report from the department about the place of the death as well as date of the death of deceased, in these two petitions as well as legal heirs of these two deceased, in order to determine that whether the earlier petition is a cross-petition with this petition, on account of the same deceased. 4.

Office to submit the report within 05 days, from the date of uploading this order. Ld. Advocate for the petitioner to bring this order to the notice of the department for timely compliance.
