Perused Petition. Deceased died on 23.10.2015 leaving behind his widow namely Kamal Salunkhe. Said widow died on 26.05.2024 the petitioner claims an inheritance thorugh his father, namely Rajaram who died on 30.08.2006 (i.e. Pre-deceased the deceased) Hence, vide Section 9 or as per Section 15(1) (b) read with Rule 3 of Section 16 of the Hindu Succession Act, 1956 any surviving brother can claim an inheritance. Hence, petitioner being Class-II entryIV has no occasion to claim an inheritance in existence of Class-II Entry-IV legal hiers. Hence, adjourned.
