TP/1549/2025 (E-filing) Mr. Bhairavnath Jadhav, Advocate for petitioner PC : 1. Perused petition. Heard Ld. Advocate for petitioner. As per praecipe dated 02.07.2025, Ld. Advocate for petitioner prayed for refund of court fees as per the Government Notification bearing No. Mudrank-2023/C.R.641/M1(Policy) dated 09.08.2024. This petition is filed by widow of deceased for Letters of Administration to the property and credits of deceased namely Dattatray Pandurang Patil. In this petition, petitioner has paid court fees of Rs. 15,000/-.

2. Ld. Advocate for petitioner submits that court fees for widows by filing probate of Will or Letters of Administration, with or without Will specified in Article 10 of the First Schedule appended to the Maharashtra Court Fees Act, 1959, for obtaining heirship certificate has been reduced from Rs. 75,000/- to Rs.10,000/-. This petition is filed on 28.02.2025 and therefore, the said Notification is applicable to this case.

3. Ld. Advocate for petitioner has produced the copy of challan in the name of petitioner namely Kanta Dattatray Patil. Ld. Advocate for petitioner that there is no other petition is filed for Probate, Letters of Administration, Succession Certificate or Heirship Certificate in respect of the identical properties of the same deceased.

4. Ld. Advocate for petitioner has produced the deface challan of Rs.10,000/- which is already paid on 28.02.2025 and the same is on record and prior to that petitioner has paid Rs.15,000/- court fees on 20.02.2025 erroneously in the name of petitioner herein. This office has received letter dated 06.05.2025 for no-objection certificate for the said challan from the office of the Collector of Stamps, Mumbai.

5. In view of the Notification dated 09.08.2024, office is directed to issue refund certificate as regards the court fees of Rs.15,000/- which is paid on 20.02.2025 as per rules in the present petition. 03.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
