TP/1592/2025 (E-filing) Ms. Kiran Singh i/b. Pooja Thorat, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament alongwith Codicil of deceased filed by petitioner namely Parul Kaushik Gandhi being sole Executor named under the Will of deceased. The deceased namely Mrudula Kanjibhai Gohil died at Mumbai on 10.03.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 06.07.2016 and Codicil was duly executed at Mumbai on 10.02.2023. The said Will and Codicil are in English language. The Para No. 3 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that Para No. 11 of the petition parents, brother and sister of deceased predeceased the deceased. petitioner is not known whereabouts of parent's side of legal heirs of deceased. As per section 15 of the Hindu Succession Act, 1956 petitioner is required to states the legal heirs of husband side of deceased. Para Nos. 6 and 11 of the petition are incomplete hence, Advocate to take steps.

4. Petitioner's oath is filed. Affidavits of Mahesh Vasant Tandel dated 01.03.2025 and 27.02.2025 one of the Attesting Witness to the Will and Codicil are filed respectively. Affidavit of Service of General Citation dated 34.04.2025 is filed.
