1. The Ld. Advocate for the Petitioner submits that the property mentioned at Sr. No. 1 in the schedule-I was initially in the name of the deceased No.1 and after his death, on count of nomination, the said property is transferred in the name of the deceased No.2. She showed the Copy of the Share Certificate in this regard.

If this submission is considered then, the petitioner to state what property the deceased No. 1 has to grant the Letters of administration. Furthermore, to entertain the joint petition, there must be property, which has been held by the deceased jointly. Hence, the petitioner to point out that which property is held by the deceased No.1 and 2 jointly, so that benefit under Sec. 29 of the Maharashtra Court Fee Act, 1959 will be given to him. Ld. advocate for the petitioner seeks time to seek instructions in this regard, hence, adjourned.
