TP/1765/2025 (E-filing) Mr. V. P. Vaze, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Vaijanath Pandurang Vaze being one of the Executors named under the Will of deceased. The deceased namely Dr. Leela Vasant Gokhale died at Mumbai on 11.09.2016. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 29.05.2010. The said Will is in English language. The Para No. 9 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. Petitioner is one of the executors and Affidavit of reserving or renouncing the rights of another executor namely Girish Vasant Nawathe is not filed.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased was survived by one son and one daughter. Out of them son has given his consent in favour of the petitioner. Consent Affidavit is on record. Daughter of deceased has given authority to her brother Anil who is son of deceased for filing consent Affidavit and Power of Attorney is not annexed to the petition. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Anuradha Khanpurkar dated 31.01.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 28.04.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for grant. Hence, remove from board. 25.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
