Ld. advocate for the petitioner has submitted that the petitioner is not aware about the legal heirs of the Husband of the deceased as per Rule 3 of Section 16 read with Sec. 15(1)(b) and Sec. 8 to 13 of the Hindu Succession Act, 1956. Furthermore, the petitioner shall aver the facts as to efforts of the petitioner to find out the legal heirs of the deceased.

Hence, the petitioner to made detail averment about the capacity to present the petition in the petition, which entitles the petitioner to present the petition, as per the provisions of the Indian Succession Act, 1925. 3.
