TP/1850/2025 (E-filing) Mr. Ram Mohite i/b. Shettigar Satyakumar Madhukar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Vipul Hemant Mehta being sole surviving Executor named under the Will of deceased. The deceased namely Hemant Premananddas Mehta died at Mumbai on 02.05.1993. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 10.02.2025 for dispensation of identification proof of deceased. The same is accepted.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 02.09.1992. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. One executrix namely Sharmishtha Hemant Mehta died on 02.02.2022 hence, petitioner sole surviving executor.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Wife of deceased since deceased the deceased. Deceased was survived by one son and one married daughter. Out of them son is petitioner herein and the married daughter has given her consent in favour of the petitioner. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Dilip Chavda dated 16.01.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 28.05.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
