Heard Mr. Kantawala, learned Advocate for Petitioner. 3.

Perused the praecipe dated 26.09.2025 and the Testamentary Petition alongwith annexures appended to it.

This Testamentary Petition seeks issuance of probate in respect of the last Will and Testament dated 19.02.2019 of deceased Nandubala Mahesh Thakkar who expired on 13.09.2024 at her residence in Mumbai. Petition is filed by the nephew. Apart from the Petitioner, the details of other legal heirs are stated in paragraph No.4 of the Petition. Consent Affidavits dated

13.01.2025 of the said legal heirs are appended from page Nos.53 onwards. The Affidavits of the attesting witnesses are at page Nos.71 and 75 of the Petition.

5. The Executors' oath is at page Nos. 49 to 51 of the Petition. I have perused the same. The same is in order.

6. In view of the above, there can be no impediment in allowing the Petition. Hence, Petition stands allowed in terms of prayer clause (a) which reads thus:- "(a) That Probate be granted to the Petitioners in respect of the Last Will and Testament dated 19th February 2019 to have it effect throughout the state of Maharashtra." 7.

The Testamentary Department is directed to issue grant / probate to the Petitioner within a period of six weeks from today, subject to all requisite compliances and strictly in accordance with law.

Issuance of proclamation, if any, stands dispensed with. 9.

Testamentary Petition is disposed.

10.

Praecipe is also disposed.
