TP/1897/2025 (E-filing) WITH WILL/777/2025 Ms. Nerissa Almeida i/b. Lambay Alisha Riyaz, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Asha Ashok Arjunwadkar being sole Executrix named under the Will of deceased. The deceased namely Ramchandra Trimbak Atre died at Mumbai on 25.07.2012. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 04.02.2004. The said Will is in Marathi language and translation of the said Will is annexed to the petition however, Affidavit of Advocate for petitioner certifying that true and correct translation of the said Will is not annexed to the petition. The Para No. 4 of the Will refers to the appointment of Executrix. Only one Executrix appointed under the Will who is petitioner herein. The property mentioned in Schedule I annexed to the petition is referred in the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Widow of deceased since deceased the deceased. Deceased was survived by one son and two daughters who all have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Shrikrishna Purshottam Kashikar dated 17.02.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 12.06.2025 is filed. Delay is explained and the same is condoned.

5. Ld. Advocate for petitioner file an praecipe to place the matter on board as and when all compliance done and matter is completely ready for final grant. 07.01.2026 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
