TP/1919/2025 (E-filing) Ms. Ridhi Shah i/b. Shah and Furia Associates, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Harish Hiriyanna Hegde being sole Executor named under the Will of deceased. The deceased namely Rajkumari Vishno Chhabria died at Mumbai on 03.08.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 11.06.2023. The said Will is in English language. The Page No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. Page No. 2 of the Will refers to the properties which are mentioned in the Schedule I annexed to the petition.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Deceased died issue-less. Husband of deceased had one brother namely Nandlal Chhabria who died leaving behind one son and one daughter. The daughter of said Nandlal namely Vaishali also died leaving behind her two sons. Deceased was survived by one nephew and two grandsons. Out of them both the grandsons have given their consents in favour of the petitioner herein. Consent Affidavits are on record. Nephew of deceased has been served with the citation through the office of Sheriff, Mumbai and Affidavit of Service dated 02.08.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Lalchand Kalra dated 11.03.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 30.07.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
