23. TP/1923/2025 WITH WILL/747/2025 Shri Hussain Dholkawala, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Keki Bomi Dadiseth being the Executor named under the Will of deceased. The deceased namely late Shri Alloo Keki Dadiseth, died at Mumbai on 08.02.2024. Copy of death certificate is annexed to the petition. Copy of AADHAR Card is annexed for the identification purpose.

2. The deceased left behind him last Will and Testament which was duly executed at Mumbai on 29.07.2023. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of two Executors out of them one is Petitioner herein and Smt. Natasha Dotiwala has reserved her rights as an Executor by an affidavit dated 04.02.2025.

3. As per para 9 of the Petition the parents predeceased the deceased and deceased is survive by husband and one daughter. The husband is Petitioner herein, the daughter has given her consent in favour of the Petitioner herein.

4. The affidavit of attesting witness Mr. Arnaz Bhiwandiwala and Phiroja David both dated 04.02.2025. The affidavit of general citation is filed and it is dated 20.06.2025.
