Heard Mr. Wani, learned Advocate for Petitioner. 2.
Present Petition is filed by Petitioner for issuance of Succession Certificate under Section 372 of Indian Succession Act, 1925 in respect of the properties and credits of deceased Dominic Francis Lopes And Livia Lopes W/O Dominic Lopes. The name and details of legal heir of the deceased are stated in paragraph No.4 of the Petition. Purpose for filing the present Petition is stated in paragraph No.10 of the Petition. I have perused the same. 3.
Consent affidavits dated 10.09.2024 of Mary Melvyn Lopes, Savio Melvyn Lopes, Maria Melba Lopes, Melroy Terrance Lopes, the legal heirs are appended to page Nos. 22, 27, 32 and 37 of Petition. 4.
In view of the above, there can be no impediment in
M5.1937.2025.doc allowing the Petition. Testamentary Petition is allowed and disposed of in terms of prayer clauses at un-numbered paragraph which read thus:- "The petitioner therefore prays that a succession certificate may be granted to the petitioner in respect of securities set forth in Schedule I hereto, with power to collect the said securities or transfer,to receive interest on said Debts." 5.
Issuance of proclamation stands dispensed with. 6.
Department is directed to issue the succession certificate as directed above within a period of 3 weeks from today positively. 7.
Petition is allowed and disposed subject to compliance of office objections, if any, forthwith which shall be allowed by the Department.
