TP/1965/2025 (E-filing) Mr. Siddharth Desai, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Rajendra Chunilal Panchal being one of the Executors named under the Will of deceased. The deceased namely Sharadchandra Lallubhai Patel died at Bilimora, Gujarat on 23.01.2025. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 22.06.2024. The said Will is in English language. The Para No. 18 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. Petitioner is one of the executors and another executor namely Manish Rajendra Chokshi has renounced his rights as an Executor and Affidavit dated 10.03.2025 is filed to that effect.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased had one son and three daughters. One daughter namely Kaushika Patel died on 06.08.2021 leaving behind one son and one daughter. Deceased was survived by two daughters, one son, one grandson and one granddaughter. All the legal heirs of deceased have given their consents in favour of the petitioner. Consent Affidavits are on record. Consent Affidavit of grandson of deceased namely Harshvardhan Patel is not filed.

4. Petitioner's oath is filed. Affidavit of Vipul Patel dated 10.03.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 06.06.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant. Hence, remove from board. 03.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
