TP/2008/2025 (E-filing) Ms. Jyoti Badgujar i/b. Lakdwala and Co., Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. Ld. Advocate for petitioner has filed praecipe for exemption of court fees. In para No. 8 of the petition, Advocate stated that the petitioners have filed this petition for Letters of Administration (Debonis Non) to the property of Laxman Sitaram Jadhav.
2. There is another petition filed by the petitioners herein alongwith the other petitioners the TP No. 1621 of 2012 for the Letters of Administration for the same same property as mentioned in the petition herein. Deceased in both the matters is same, schedule of property is also identical in both the petitions. Full court fees has been paid in TP No. 1621 of 2012 therefore, in the present petition Ld. Advocate for petitioner seeking exemption of court fees under section 23 of the Maharashtra Court Fees Act, 1959.

In my opinion, the petitioner is entitled for exemption of court fees under section 23 of the Maharashtra Court Fees Act, 1959 as the deceased and his estates are the same and identical in both the petitions. The court fees exemption is granted. Ld. Advocate for petitioner undertakes not to seek refund of court fees in TP No. 1621 of 2012.
