TP/2041/2025 (E-filing) Mr. Dipesh Siroya i/b. L I M Legit, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. The present petition is filed for Succession Certificate for the securities belonging to deceased namely Narayandas Ramchand Daswani by the nephew of deceased namely Dinesh Shivo Daswani. The securities mentioned in the Schedule I of the petition are the securities jointly owned by the deceased with Daru Narayandas Daswani.

2. Ld. Advocate for petitioner points of out para No. 10 of the petition, wherein the petition for Succession Certificate being TP No. 919 of 2023 was filed for the securities belonging to Daru N. Daswani and Succession Certificate was granted on 06.01.2024. However, copy of grant is not annexed to the petition. Since, properties mentioned in the Schedule is jointly owned by the deceased herein and Daru N. Daswani. Ld. Advocate for petitioner states that court fees of Rs.75,000/- was already paid in TP No. 919 of 2023.

In view of thereof, upon uploading the defaced copy of Challan of payment o court fees in TP No. 919 of 2023 on the official portal of the Bombay High Court, petitioner will be entitled for the exemption of court fees in the present petition as per section 23 of the Maharashtra Court Fees Act, 1959. Hence, exemption of court fees is granted as per section 23 of the Maharashtra Court Fees Act, 1959.
