TP/2047/2025 (E-filing) WITH WILL/813/2025 Ms. Pratiksha Babar i/b. Sujata Babar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Prashant Dattaram Lad and Ujwala Prashant Lad being Executors named under the Will of deceased. The deceased namely Selvaraj Anbusudaram Pillai died at Mumbai on 05.09.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 17.06.2019. The said Will is in English language. The 1st page of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who are petitioners herein. The property mentioned in Schedule I annexed to the petition is referred in the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by his widow, one son and one daughter. Out of them widow and daughter have given their consents in favour of the petitioner herein. Consent Affidavits are on record. Son of deceased has been served with the citation through the office of Sheriff, Mumbai and Affidavit of Service dated 08.12.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Prashant Shinde and Mahesh Surve dated 22.03.2025 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 15.07.2025 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
