This petition is for Succession Certificate in respect of certain debts belonging to deceased filed by petitioner namely Rajendra Dolatrai Shah being brother of deceased. Deceased namely Dulari Jagdish Shah died intestate at Mumbai on 10.02.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition.

2. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Son of deceased namely Nilay Shah predeceased the deceased who died as bachelor. One daughter of deceased namely Charul Shah died as spinster. The para No. 4 of the petition states that there are no legal heirs from the husband side of deceased. Deceased had no sister and was survived by four brothers. Out of them one brother petitioner herein and remaining three brothers have given their consents in favour of petitioner. Consent Affidavits are on record. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 18.02.2025 and Administration Bond dated 17.05.2025 are filed. All other legal formalities are complied with. Hence, petition is granted.
