TP/2103/2025 (E-filing) Mr. Jayant Wani i/b. Lakdawala and Co., Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. Ld. Advocate for petitioner has filed praecipe dated 03.04.2025 seeking exemption of court fees in the present petition as it is in nature of de-bonis non.
2. In para No. 9 of the petition, Ld. Advocate for petitioner has stated that Gopal Madansingh Moorjani had filed petition No. 535 of 2015 for Letters of Administration for the estate of deceased namely Hari Madansingh Moorjani and grant was issued on 12.02.2016. The said petitioner namely Gopal died without administering the estate of deceased on 12.02.2024 and copy of death certificate is annexed to the petition as Exhibit - "C".
3. The copy of grant in TP No. 535 of 2015 is annexed to the petition as Exhibit - "I". The court fees has already paid in the said petition of Rs.75,000/-.
4. In view of the above, petitioner has stated in para No. 8 of the petition since the court fees has already been paid for the properties of deceased mentioned in the Schedule I, the petitioner is entitled for exemption of court fees under section 23 of the Maharashtra Court Fees Act, 1959. Petitioner is directed to surrender the grant issued in TP No. 535 of 2015. Upon such surrendering of the grant, petitioner is entitled for exemption of court fees.
