TP/2199/2025 (E-filing) Mr. Jayant Wani a/w. Jyoti Badgujar i/b. Lakdawala and Co., Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Prem Gul Rajani being sole Executor named under the Will of deceased. The deceased namely Roma Manohar Thadani died at Mumbai on 15.04.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 11.07.2008. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Deceased was survived by one son and one daughter. Out of them son is petitioner herein. Consent Affidavit of daughter is not filed. There are no other legal heirs.

4. Petitioner's oath is filed. Ld. Advocate for petitioner states that in para No. 9 of the petition, it is stated that one Attesting Witness namely Saroj Belani has expired and another Attesting Witness namely Pushapa Wadhwani has failed to furnish her Affidavit as an Attesting Witness and therefore, has requested the Affidavit of Naresh Manohar Thadani be accepted as an Affidavit of Attesting Witness under Rule 384 of the Bombay High Court (Original Side) Rules, 1980. Affidavit of Naresh Manohar Thadani dated 10.02.2025 is accepted. Affidavit of Service of General Citation dated 04.07.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant.
