Perused Petition. Under the Will, the Deceased appointed, said (1) Ajay Harilal Choksi and (2) Samir Prathik Choksi, as Executors. It is stated that the both executors are unable to fulfill their responsibilities as Executors. Hence, the petitioner, being the legatee under the Will, has filed this petition.

However, the petitioner has not produced the renunciation affidavit in this regard. hence, the petitioner either to file affidavits of the executors or comply Sec. 230 of the Indian Succession Act, 1925. 3.
