PC : 1. Perused Petition. Heard Petitioner. The present petition is filed by Petitioner being granddaughter of deceased for Letters of Administration in respect of properties and credits of of deceased namely Malti Gangaram Darade.
2. In para No. 6 of the petition, petitioner has stated that earlier daughter of deceased namely Pradnya Naik had filed Testamentary Petition No. 2895 of 2024 for Letters of Administration to the property and credits of deceased and it was granted on 31.08.2024. However, the said daughter expired on 07.10.2024 without administering the assets of the deceased. Copy of the said grant is annexed to the petition as Exhibit - "C".
3. Petitioner has paid the court fees of Rs.75,000/- in the earlier petition being Testamentary Petition No. 2895 of 2024. Since, the deceased and her assets are the same and identical in both the petitions, petitioner is entitled for exemption of court fees in the present petition.
4. In view of thereof, petitioner is entitled for exemption of court fees in the present petition as per section 23 of the Maharashtra Court Fees Act, 1959. 06.01.2026 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
