1. Ld. Advocate for the Petitioner submitted that deceased was Hindu and according to the provisions of the Hindu Succession Act, 1956 legal heirs are shown in the petition as per Section 9 of the Hindu Succession Act, 1956 and brother of the deceased fall under the category of Class-II entry-II as deceased was hindu, provisions of Hindu law will apply.

2. In para no. 10 of the petition, it is specifically stated that deceased married to a Christian namely Pamela. She since deceased the deceased on 17.04.2024. Hence, petitioner to state whether deceased married with Pamela Gale Monet, under the provisions of the Special Marriage Act, 1954 to ascertain the legal heirs of the deceased as per laws.
