TP/2347/2025 (E-filing) Mr. Rushabh Thacker, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain debts and securities belonging to deceased filed by petitioner namely Shailesh V Chahuan being son brother of four deceased persons. Deceased No. 1 namely Velji Mulji Chahuan died intestate at Mumbai on 22.06.2006. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Election Card is already annexed to the petition. Deceased No. 2 namely Kuvwarben Velji Chahuan died intestate at Mumbai on 03.05.2020. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition. Deceased No.

3 namely Bhavana Velji Chahuan died intestate at Mumbai on 13.10.2021. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition. Deceased No. 4 namely Mahesh Velji Chahuan died intestate at Mumbai on 29.07.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased Nos. 1 and 2 were husband and wife. They have three children namely Bhavana, Mahesh and Shailesh who all the three are disable. Out of them Bhavana and Mahesh are died hence, they are deceased Nos. 3 and 4 herein. Shailesh is petitioner herein. The present petition is filed by Prakash Ramesh Chahuan as his legal guardian appointed by certificate issued by National Trust, Ministry of Social Justice and Empowerment (Divyangan), Government of India. The said certificate is annexed to the petition as Exhibit - "J". The petitioner therefore, only surviving son of deceased Nos. 1 and 2 and brother of deceased Nos. 3 and 4. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 14.07.2025 and Administration Bond dated 03.07.2025 are filed. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted. .......2
