1. In a Will, movable properties were bequeathed to the petitioner. According to him, all these properties have been disposed of by virtue of the Will. Ld.
advocate for the petitioner submits that widow of the Deceased, namely Ranjana, has given the consent to the petitioner to present the petition.
Hence, petitioner can present the petition for administration of the properties.
2. However, the properties, which are mentioned in the Schedule-I of the petition, are not bequeathed to the petitioner but bequeathed to widow of the deceased. Hence, petitioner is not legatee to the extent of subject matter of the petition. Hence, it would be proper to hear Ld. advocate for the petitioner about the capacity of the petitioner to present petition, in such capacity.
