Heard Ms. Warerkar, learned Advocate for Petitioner. 2.

Petition is filed for seeking issuance of Grant in respect of the property and credits of deceased.

In view of the averments made in the Petition, it is seen that Petition is filed by son of the deceased through his legal guardian. Legal guardian is the father's sister. It is seen that Petitioner in paragraph No. 8 has made an averment with respect to the disability for whom she has been appointed as Legal Guardian. The order of appointment is also appended. I have perused the same and there can be no impediment as to why the Petition cannot be granted. 4.

Ms. Warekar informs the Court that Department has raised requisition that Petitioner ought to justify the surety in view of the fact

910. TP-2599-25.docx that Petitioner is represented by a legal guardian. In my opinion such justification is not required in the facts and circumstances of the present case and the relationship of the parties. 5.

In view of the above, Petition stands allowed. The requisition stands dispensed with. Department is directed to ensure that Grant is issued to Petitioner rather to the legal guardian of Petitioner within a period of three weeks from today positively. Department shall act on server copy of this order.

Petition is allowed and disposed.
