1. Perused Petition.

2. Petition has been filed for the Letters of administration of the properties left by INDUMATI P. SHETH alias INDUMATI PRAVINCHANDRA SHETH (a deceased).

Deceased died widow and issue-less.

3. The petitioner being Nephew of the deceased's Husband vide Sec. 15(1)(b) read with Rule 3 of Sec. 16 of the Hindu Succession Act, 1956, has filed the petition. However, a Anusaya, a mother of the petitioner and Sister-in-Law of the deceased, who comes prior to the petitioner in legal heirs entry as per Sec. 9 of HS Act, has the preference than the petition. Accordingly, only Anusaya has a right to claim an inheritance to the property left by the deceased.

4. Hence, petitioner to explain how Chetan can be the heir of the deceased in the lifetime of Ansuya Doshi
