TP/2670/2025 (E-filing) Ms. Diksha Shetty i/b. AAK Legal, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of Photocopy of last Will and Testament of deceased filed by petitioner namely Sunil Siddharth Lalbhai being one of the Executors named under the Will of deceased. The deceased namely Siddharth Kasturbhai Lalbhai died at Gujarat on 13.09.1998. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Gujarat on 11.02.1997. The said Will is in Gujarati language and official translation of the Will is annexed to the petition and Affidavit of Advocate namely Parth Turakhia dated 26.08.2025 for certifying the true and correct translation of the said Will is filed. The Para No. 4 of the Will refers to the appointment of Executors. Only four Executors appointed under the Will. Petitioner is one of the executors and remaining three executors namely Vimla S. Lalbhai, Swati S. Lalbhai and Taral S. Lalbhai have renounced their rights to act as an executors and Affidavits all dated 01.04.2025 are filed to that effect.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by widow, one son and two daughters. Out of them son is petitioner herein and the widow and two daughters have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of B. N. Mohanan dated 09.01.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 31.07.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
