1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Kiran Rasiklal Sanghavi being one of the Executors named under the Will of deceased. The deceased namely Jayant Mohanlal Sanghavi died at Mumbai on 14.08.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 24.12.2021. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executors. Only three Executor appointed under the Will. Petitioner is one of the executor and another executrix namely Aarti has reserved her rights to act as an executrix and Affidavit dated 10.06.2025 is filed to that effect. Remaining executrix namely Tripti died on 27.05.2024 as stated in para No. 5 of the petition.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased died as bachelor. One brother of deceased namely Rasiklal Sanghavi predeceased the deceased leaving behind one son and two daughters. Deceased was survived by one nephew and two nieces. Out of them nephew is petitioner herein and one niece namely Aarti has given her consent in favour of the petitioner. Consent Affidavit is on record. Another niece of deceased Tripti died leaving behind her one son namely Hrishikesh Kailash Sheth and who has given his consent in favour of petitioner herein. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Pradeep P. Sagar and Amit A. Gunderia dated 08.02.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 15.07.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
