TP/2796/2025 (E-filing) Mr. Jay Varia, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Harinder Singh Sapra being one of the Executors named under the Will of deceased. The deceased namely Sudershan Sapra died at Mumbai on 23.12.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 11.08.2017. The said Will is in English language. The Para No. 3 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will. Petitioner is one of the executors and another executor namely Barinder Singh Sapra died on 07.06.2023 and copy of death certificate is annexed to the petition as Exhibit - "F". Affidavit of renouncing or reserving the rights of remaining executor namely Jasleen Singh is not filed. Residuary clause in respect of properties of deceased is mentioned at para No. 11 of the Will.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. One son of deceased namely Barinder Singh predeceased the deceased leaving behind his widow, who died issue-less. Deceased was survived by one son, one daughter, one daughter-in-law. Out of them son is petitioner herein and the daughter and daughter-in-law have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Tejinder Singh Makkar and Harvinder Kaur Makkar dated 04.03.2025 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 19.07.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is completely ready for final grant.
