TP/2894/2025 (E-filing) Ms. Lisa Chittilappilly i/b. Darryl Pereira, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament alongwith Codicil of deceased filed by petitioner namely Darryl Peter Martis being sole one of the Executors named under the Will of deceased. The deceased namely Keith Peter Suares died at Mumbai on 01.12.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 30.09.2022 and the Codicil was duly executed at Mumbai on 14.11.2022. The said Will and Codicil are in English language. The Para No.1 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will. Petitioner is one of the Executors and another executor namely Larry Rebello has renounced his rights to act as an Executor and Affidavit dated 10.03.2025 filed to that effect. Affidavit for renouncing the rights of remaining executor namely Ralph Pais is not filed.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased died as bachelor. One brother of deceased namely Patrick died on 30.05.2023 leaving behind his widow, two sons and one daughter. Deceased was survived by two sisters, one brother, one sister-in-law, one niece and two nephews who all have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Christopher Pinto dated 03.03.2025 one of the Attesting Witnesses to the Will and Codicil are filed. Affidavit of Service of General Citation dated 22.07.2025 is filed.
