This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Dipti Bharat Padia being niece of both the deceased. Deceased No. 1 namely Dilipkumar Virjibhai Marthak died intestate at Mumbai on 26.02.2000. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pancard is already annexed to the petition. Deceased No. 2 namely Savitaben Dilipkumar Marthak died intestate at Mumbai on 30.06.2010. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pancard is already annexed to the petition.

2. Ld. Advocate for petitioner submits that parents of both the deceased predeceased the deceased. Both the deceased died issue-less. Deceased No. 1 had one brother namely Himatlal Marthak died on 04.07.2019 leaving behind one daughter. Both the deceased were survived by one niece only who is petitioner herein. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 25.07.2025 is filed. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.
