TP/2918/2025 (E-filing) Mr. Mangesh Kokare, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Muffazal Mansoor Golkhaw being son of deceased No. 3 and grandson of deceased Nos. 1 and 2 of deceased. Deceased No. 1 namely Ismail Mohammed Ali died intestate at Mumbai on 21.09.1991. Copy of death certificate is annexed to the petition. Deceased No. 2 namely Memoona Esmailjee Tapia died intestate at Mumbai on 22.04.2001. Copy of death certificate is annexed to the petition. Deceased No. 3 namely Nafisa Esmailji Tapia died intestate at Mumbai on 10.01.2007. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 25.04.2025 as regards non-availibility of identification proof of deceased Nos. 1 to 3. The same is accepted.

2. Ld. Advocate for petitioner submits that parents of deceased No. 1 predeceased the deceased. Deceased No. 2 is wife of deceased No. 1. Deceased Nos. 1 and 2 had only one daughter who died and she deceased No. 3 herein. Deceased No. 3 died leaving behind one son who is petitioner herein. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 26.08.2025. As petitioner is sole surviving legal heir of the deceased before this Court and the right or interest of no other legal heir is required to be protected. Hence, Administration Bond is dispensed with. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.
