TP/3009/2025 (E-filing) Ms. Anita Manjalkar, Advocate for petitioner. PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain Securities belonging to deceased filed by petitioner namely Dilip Kantilal Shah, who is Son of both deceased. Deceased no. (1) namely Kantilal Karsandas Shah, said to be died intestate at Mumbai on 13.02.2002. Copy of death certificate is annexed to the petition as Exhibit - "A". Identification proof of deceased no. 1 viz. copy of Election card is already annexed to the petition as Exhibit - "A-1".

Deceased no. (2) namely Jawal alias Javal Kantilal Shah, said to be died intestate at Mumbai on 25.06.2001. Copy of death certificate is annexed to the petition as Exhibit - "B". As petitioner has filed Affidavit dated 28.03.2025 for non-availability of identification proof the deceased, which is filed through e-filed.

2. Ld. Advocate for petitioner submits that parents of both the deceased predeceased the deceased. Ld. Advocate states that both Deceased were husband and wife. Both deceased were survived by only one son, who is petitioner herein. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 18.07.2025 and Administration Bond dated 29.07.2025 are filed separately through e-filing. Delay is explained. All other legal formalities are complied with. Hence, petition is granted.

4. Office to issue Succession Certificate as prayed after verifying whether any cross petition is filed or whether any Affidavit opposing grant is filed.
