Petitioner to take steps to amend the capacity, vide as per the Section 233 of the Indian Succession Act, 1925, as a representative the sole Legatee, namely VERONICA D'SA (a widow of the testator), under the Will.

Furthermore, petitioner to satisfy that the Codicil is executed as per the provisions of the Indian Succession Act, 1925. if the codicil is not properly executed, then the petitioner to satisfy that how the property mentioned at Sr. no. 2 can be subject matter of this petition.

The petitioner to comply the requisition of Rule 383 of the the Bombay High Court (OS) Rules, 1980 as per note annexed to the Form No. 102 of BHC Rules, as there is correction/addition or deletion, etc., in respect of the Will.
