This Petition seeks issuance of probate in respect of the last Will and Testament of Shripal Kantilal Shah. Petition is filed by the Executor named in the Will. The three legal heirs named in the Will are the wife, son and married daughter whose names and details have been given in paragraph No.8 of the Petition. 4.
Consent affidavits dated 19.03.2025 and 09.12.2025 of Dipti Piyush Shah, Riddhi Mohin Hirani nee Riddhi Shripal Shah, Bhagwanti Shripal Shah and Sneha Shripal Shah, the legal heirs of the deceased are appended to page Nos. 35, 37, 39 and 41 of the Petition. Affidavit of Executor and Affidavit of attesting witness are both appended at page No.
M3.TP.3028.2025.doc 28 and 31 of the Petition . I have perused the same. The same are in order.

For the averments mentioned in the Petition and submissions made by Mr. Saraf, Testamentary Petition is allowed in terms of the relief prayed.

Testamentary Department is directed to issue grant / probate having effect throughout the State of Maharashtra subject to all other compliances and strictly in accordance with law within a period of four weeks from today positively.

With the above direction, Testamentary Petition stands disposed.
