TP/3035/2025 (E-filing) WITH WILL/1147/2025 Mr. Satish Prasanna i/b. Vidhi, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Vijay Satish Nayak being sole Executor named under the Will of deceased. The deceased namely Meena Satish Nayak died at Mumbai on 16.08.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 16.05.2015. The said Will is in English language. The Para No. 4 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. The Schedule I of the petition refers to the three flats are mentioned in para Nos. 2, 3 and 6 of the Will.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Deceased was survived by two sons and one daughter. Out of them one son is petitioner herein and the Affidavit of Service of citation dated 28.11.2025 (para No. 2) upon the another son and daughter is incomplete. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Vijay Shankarlal Kapoor dated 20.04.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation is not filed. Delay is explained and the same is condoned.
