1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Rajan Prasanna Kirtikar being nephew of deceased. Deceased namely Sumedha Prabhat Kirtikar died intestate at Mumbai on 08.12.2007. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pancard is already annexed to the petition.

2. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Deceased had one daughter and one son. Daughter of deceased namely Rubaya predeceased the deceased, who died as spinster. As the whereabouts of the son of deceased namely Romulus are not known hence, petitioner has obtained the order of presumption of death dated 23.01.2026 passed by this Hon'ble Court in MPTL No. 952 of 2026. Deceased had two brothers-in-law, who are since deceased the deceased. As per para No. 4 of the petition, deceased was survived by four nephews and two nieces. Out of them one nephew is petitioner herein and all other legal heirs have given their consents in favour of petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 10.12.2025 and Administration Bond dated 10.12.2025 are filed. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.
