Priya Kiran Thakur, the petitioner, has filed this petition for the grant of the Letters of Administration to the properties left by her brother, namely Sunil Ramakant Tirodkar (for short "the deceased"). The deceased died divorcee and left his daughter, namely Tanvi Sunil Tirodkar who is mentally retarded.

According to the petitioner, said daughter is missing since 08.06.2007 and such pleading is introduced in paragraph No. 3 of the petition. The petitioner further presumed that said Tanvi Tirodkar is dead. However, no such declaration is obtained and/or this fact is not proved, as per the Law. Hence, unless, this fact is proved, the petitioner's capacity u/s 218 of the Indian Succession Act, 1925 comes in question. Hence, the petitioner to take appropriate proceeding in this regard.
