Present matter is called out today from the remaining board of 08.10.2025.

Heard Ms. Shah, learned Advocate for Petitioner. Interim Application (L) No. 27225 of 2025:- 3.

Perused the Application. For the reasons stated therein, Interim Application is allowed in terms of prayer clauses (a) and (b) which reads thus:- "a) this Hon'ble Court to declare that Tanvi Sunil Tirodkar, daughter of the deceased Sunil Ramakant Tirodkar, is presumed to be dead in view of Section 111 of the Bhartiya Sakshya Adhinimay 2023. b) Direct that the said presumption of death be recorded for all legal and administrative purposes, including for the grant of Letters of Administration."

3.1. Amendment, if any, is permitted to be carried out within a period of two weeks from today. Re-verifications stands dispensed with.

Interim Application is allowed and disposed.

Testamentary Petition No. 3249/2025:- 4.

In view of the order passed in the above Interim Application, present Petition is taken up for hearing.

Present Testamentary Petition is filed by Petitioner for issuance of Letters of Administration in respect of the properties and credits of deceased abovenamed. The names and details of legal heirs of the deceased are stated in paragraph No.4 of the Petition. Purpose for filing the present Petition is stated in the Petition. I have perused the same.

Consent affidavit dated 17.01.2023 of Mr. Samir Ramakant Tirodkar is appended at page Nos. 28-30 of the Petition. 7.

In view of the above, there can be no impediment in allowing the Petition. Hence Testamentary Petition is allowed and disposed of in terms of un-numbered prayer clause which reads thus:- "The Petitioner therefore pray that the Letter of Administration may be granted to the Petitioner having effect throughout the State of Maharashtra"

Department is directed to issue the Letters of Administration as directed above within a period of 4 weeks from today positively. 9.

Testamentary Petition is allowed and disposed subject to compliance of office objections, if any, forthwith which shall be allowed by the Department.
