1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Aniket M Shah being Executor named under the Will of deceased. The deceased namely Prabhavati Amratlal Shah died at Mumbai on 31.08.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 30.11.2019. The said Will is in Gujarati language and official translation of the said Will received from the office of Chief Translator, High Court, Bombay, but the same is not uploaded on the official portal of the Bombay High Court. The 2nd last para of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. Petitioner is one of the executors and another executor namely Chirag Shah has renounced his rights to act as Executor and Affidavit dated 12.02.2025 is filed to that effect. The properties mentioned in Schedule I annexed to the petition are referred in the Will.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Deceased was survived by one son who has given his consent in favour of the petitioner herein. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Parasmal P. Sheth and Haresh Gandhi dated 18.02.2025 and 08.02.2025 both the Attesting Witnesses to the Will are filed respectively. Affidavit of Service of General Citation dated 29.09.2025 is filed.

5. Liberty to move for listing the matter on compliance of requisition stated in Bold hereinabove.
