TP/3320/2025 (E-filing) Mr. Rahul Agrawal i/b. Purnanand and Co., Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament alongwith Codicil of deceased filed by petitioners namely Ripusudan Satishchandra Mehra and Deepak Satishchandra Mehra being Executors named under the Will and Codicil of deceased. The deceased namely Satishchanddra Daulatram Mehra died at Mumbai on 25.10.2010. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Election Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 01.03.2004 and the Codicil was duly executed at Mumbai on 15.04.2006. The said Will and Codicil are in English language. The Page No.4 of the Will refers to the appointment of Executors. Only three Executor appointed under the Will. Petitioners are executors as per Will and Codicil and remaining executor namely Chandrakiran Mehra died on 11.05.2005 as stated in para No. 6 of the petition as per Will.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased was survived by two sons and one daughter. Out of them two sons are petitioners herein and the daughter has given her consent in favour of the petitioner. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Hitesh Bhutta and Sunil Shah dated 19.05.2025 both the Attesting Witnesses to the Will are filed. Affidavit of Seema Mehra dated 19.05.2025 one of the Attesting Witnesses to the Codicil is filed. Affidavit of Service of General Citation dated 28.07.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
