This petition is for Probate of last Will and Testament alongwith Codicil of deceased filed by petitioners namely Baman Maneck Motafram, Rohiqa Syrus Mystry, Riyaz Iqbal Chagla, Rashna Darab Dastur being Executors named under the Will of deceased. The deceased namely Iqbal Mohamedali Chagla died at Mumbai on 12.01.2025. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 22.04.2022 and Codicil was executed at Mumbai on 11.10.2024 The said Will as well as Codicil are in English language. The Para No. 1 of the Will refers to the appointment of Executors. Only four Executors appointed under the Will who all are petitioners herein.

3. Ld. Advocate for petitioner submits that deceased was survived by widow, one son and one daughter. Out of them daughter and son are petitioner Nos. 2 and 3 herein respectively and the widow has given her consent in favour of the petitioner. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Aditi Bhatt dated 07.07.2025 one of the Attesting Witness to the Will as well as Codicil is filed. Affidavit of Service of General Citation dated 22.07.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
